Our Process

Case Evaluation

We listen to your story to understand the extent of your injuries and your treatment needs.

The Retainer Agreement will be signed by both of us to enter into an attorney-client relationship.

We will have you sign authorizations that will allow us to access your medical records and investigative reports. Without this information, we would be unable to continue and evaluate your case.

Investigation and Preparation of Your Case

  • Identify all insurance policies and the policy limits.
  • Obtain all records and investigation.
  • Expert review and report.
  • Demand.

Pre-Suit Negotiations 

We at DiLeonardo Law take every client’s case seriously. We will obtain all evidence, including medical records, bills, accident reports, photos, accident reconstructions, recorded statements of witnesses, friends and family. We will hire engineering and medical experts to help further understand how the accident occurred or how your injuries will impact you in the future. We will often hire vocational experts who will assist you with job placement and will testify about your ability to work. In very serious cases, we may also hire a life care planner to help project all future costs. 
 
Once we have concluded our investigation, we will prepare a demand brochure and accompanying letter on your behalf. The letter will contain the entirety of your case, including all legal and medical proof of your claim. With your permission and our direction, we will then send out a demand for compensation and engage in pre-suit negotiations with the defendant’s insurance company. That said, many cases will have to be litigated, as the insurance company’s settlement offers are often not acceptable to satisfy your claims. 

Filing the Lawsuit 

In the event that pre-suit negotiations are unsuccessful, with your permission, we will then file and serve a summons and complaint to initiate your lawsuit. A lawsuit can be divided into three phases: discovery, pre-trial and trial. 

Discovery 

This phase will include the following: 
  • Serving interrogatories and requests for admissions.
  • Requesting the production of documents.
  • Deposing witnesses.
  • Obtaining expert witnesses. 
The discovery phase of litigation will involve the exchange of information between the parties. This includes expert reports, the defendant’s deposition and your deposition. Although it is natural for client to be nervous about this stage of litigation, you have nothing to worry about. We will do everything we can to prepare you for and guide you through this process. 

Pre-Trial 

This phase will include the following: 
  • Court motions.
  • Mediation.
  • Settlement or trial preparation. 
While many cases are litigated, the majority of them do not have to be tried. The majority of cases are settled before trial, either during mediation or before trial. 

Trial 

This phase will include the following: 
  • Jury selection.
  • Open statements made by both parties.
  • Witness testimony and cross-examination.
  • Closing arguments. 
 

Jury deliberation and verdict

We are experienced trial lawyers and we will prepare extensively for any trial. If negotiations break down and do not produce the desired result, we will meet with you and explain all aspects of a trial. 

Post-Trial 

This phase includes the appeal of a case and the collection after judgment. Once a case is tried, there still may be legal hurdles, such as appeals of the jury verdict. Although this is rare, it does still happen.
