Yes. Delaware is a “No-Fault” state. This just means that if you are involved in a motor vehicle accident, you should first go to the insurance of the vehicle in which you were riding to cover your medical expenses; this is called, “personal injury protection,” or “PIP.” This is different from other states, so a knowledgeable attorney is essential. However even with the “no-fault” you are permitted to sue for the recovery of your pain and suffering, as well as expenses over and above the full limit of the PIP coverage if it was paid out.

Delaware requires all drivers to have automobile insurance. There are three minimums that these policies must cover:

  • $25,000 for bodily injury liability per person injured in an accident
  • $50,000 for total bodily injury liability when two or more people are injured in an accident
  • $10,000 for property damage per accident

Because the defendant driver’s insurance company evaluates your personal injury claim, it is important to have a good advocate for your injuries and damages to obtain the compensation to which you are entitled, up to the full limit of the policy.

This is called being “under insured.” You may be entitled to recover further compensation from your own carrier. Again, this requires an experienced legal time to get you through the maze of obstacles insurance companies have in place.

Our attorneys will help you pursue your claim. If the defendant driver had no insurance, you may still be able to recover by presenting the claim to your own insurance company. Again, it is best to seek the assistance of an experienced legal team to get you through the hassle of making such a calim.

Contact our attorneys via phone, or with our case evaluation form. It’s free, and we’ll be able to provide you with an evaluation of your case for your car accident. Regardless, if you have a personal injury case, we do not get paid until we obtain a settlement or award for you.
